Q: What can I do with the photos I buy from you?

A: If you purchase a 5x7 or larger, you may use that print in an ad to sell a horse or for a congratulatory ad. 4x6’s may Not be used for any publication or website use. These photos are sold to you for personal use, not promotional or commercial use. You may not duplicate the photo in any way without our express written permission.

Q: When do I have to pay a usage fee?

A: If you are a professional horse person, i.e. trainer, rider, boarding stable owner, breeder or any other professional, than any ad you run or website you have to promote your business is considered promotional and you must call to discuss the photo usage. There will be a usage fee from $250 depending on the usage.

Q: Can I send a photo to a magazine to use in an article?

A: Yes, but you must first be sure you have a 5x7 or larger and be sure the publication is aware that they must contact us to negotiate an editorial usage fee.

Q.Don’t I own the photos when I buy them?

A. No. We own the copyright to our photos. That copyright is established when we create the photos. We maintain that copyright and it is not transferable. We grant usage of our photos on a case by case basis.

Q. Can I buy unlimited rights to the photo?

A. As a general course of business we do not sell our images outright. However, if your usage may be extensive we will attempt to negotiate a price that will makes sense for both of us. The marketing of our images is our business.

Q.What do I have to do to submit photos for end of the year awards?

A.You must have purchased a 5x7 of that particular photo and you must submit a 5x7 to the publication or organization. We do not issue releases for End of the Year awards publications. The Chronicle of the Horse and USEF are aware that they have the rights to include our photos if they are 5x7 or larger.

Q.Can you email me photos?

A. No, we shoot film and sell you prints. We do things the old fashioned way, with hard work, creativity and attention to quality and excellence.

Q.How long will it take to have pictures processed for personal or commercial use?

A. Pictures are usually sent within one to two weeks after the final day of the show in which the photos were ordered. If you are ordering from home, a call to the office or a direct call to James can determine the exact processing time. However, if you have a shorter time frame, call the office or James and we will do our best to accommodate your need. In most cases, upon receipt of payment and agreement with our agent Susan Benson, we can usually fedex prints in 1-3 days. Any delay in agreement with Susan, or receipt of payments would delay this process. Our business is to supply you with the photos you need, as long as the above specification are met.

Q. How do I get a release to use a photo in a publication?

A. As a general rule, we do not issue written releases. If However, the media you are using requires a verbal or written conformation, our agent Susan Benson will issue that only upon receipt of the fees due. As you can see we are very structured and serious about being paid for the commercial use of our photos, any use without following our policy will result in an invoice being issued for the amount of the specified payment as well as a fee for copyright infringement and damages.

Q. Do you send proofs?

A. We send proofs from Horseshows where we do not have photos for sale at the show. Presently that would be from Devon and Harrisburg. At all other shows we have photos for review each day. We do not photograph the last day of any show.

Q. Do you keep photos after each horseshow? Do you have old negatives?

A. We have a library of approximately 2 million negatives + from 1983 to present. If you have a photo number we can locate and print your request. The photos from each show are available at the show only.

Q. Can your photos be found on your website?

A. No. Our website is for general information and galleries of our favorite photos.

Q. Can you 'photoshop' your pictures to remove or change things I don’t like?

A. Generally, we do not manipulate our photos. Commercial users can arrange to have photos “Customized” to their needs at their own expense.

Q. Do you shoot everybody in every class?

A. No. At most horse shows we try to shoot one class of each division. Our ability to meet this goal is based on show schedule, weather and other factors. We try to get to as many exhibitors as we can.
